This website is owned and operated by GuideR Adventure LLC from the United States. Throughout the Site, the terms “we”, “us”, “platform”, “GuideR Adventure” and “our” refer to GuideR Adventure LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site, you (“User”) engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, users, customers and/ or contributors of content.

PLEASE READ THE FOLLOWING TERMS AND DISCLAIMERS CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING OR USING GUIDER ADVENTURE’S SERVICES, YOU ARE INDICATING THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE WITH THESE TERMS, OUR PRIVACY POLICY, OR ANY OTHER OF OUR POLICIES, YOU ARE NOT PERMITTED TO ACCESS OR USE THE SERVICES.

  1. GuideR Adventure – General Information
  • About. We are an online marketplace for guided adventure travel, connecting independent guides and outfitting services with customers. For more information, please refer to our website.
  • Sole discretion. We reserve the right to add/discontinue any service anytime at our sole discretion.
  1. Definitions
  • Product: Refers to any item, good, or merchandise available for purchase through our platform.
  • Service: Denotes any service offered or facilitated by GuideR Adventure or its Outfitter Partners.
  • Website and Platform: Both terms refer to www.guideradventure.com and all of its pages, subdomains, and associated services.
  • Seller Profile: Pertains to the account or profile set up by Outfitter Partners to offer and manage their services or products on our platform.
  1. Eligibility

GuideR Adventure is strictly limited to parties who can lawfully enter into and form contracts on the Internet. Users must be at least 13 years of age to use the website. To have a seller profile, users must be at least 18 years of age. By using or engaging with the website, you also acknowledge and agree that you are permitted by your jurisdiction’s applicable law to use and/or engage with the website.

  1. Additional User Assurances

You further assure and confirm that you: (a) are neither suspended nor have been previously restricted by GuideR Adventure from availing our Services; (b) are not representing or acting on behalf of any competitor to GuideR Adventure; (c) will establish only one GuideR Adventure Account; and (d) possess the complete authority to consent to this binding contract, ensuring no breach of any other agreement you’re a part of.

  1. Right to Deny Access

GuideR Adventure reserves the right, at its sole discretion, to deny anyone access to the Services at any time for any reason, including but not limited to violations of these Terms and Conditions.

  1. Exposure to Content

While accessing or using the Website, you might come across content that can be deemed inappropriate, inaccurate, offensive, or objectionable. GuideR Adventure neither endorses nor guarantees the accuracy of such content. Consequently, you access and utilize the Website at your own discretion and risk.

  1. Relationship and Use of Services

Your interaction with us concerning the utilization of our Services, including any reservations for any tour, ticket, attraction, activity, or event (referred to herein as an “Adventure Experience”) showcased on the Website and offered by a third-party provider, is governed by these Terms and Conditions (each experience is termed a “Feature”).

  1. Service Access, Bookings, and Account Creation

By accessing or using the Services, making a reservation for a Feature (“Reserve”, “Reservation”), and/or establishing an account on our Website (known as a “GuideR Adventure Account”), you acknowledge your acceptance of these Terms and Conditions in their entirety. You hereby confirm that you have thoroughly read and comprehended them. In every Reservation process, the individual initiating the Reservation is considered to have agreed to these Terms and Conditions on behalf of all individuals listed in the Reservation.

To avail certain features on the Website, including making a Reservation, you might need to set up a GuideR Adventure Account and furnish personal details. You bear the responsibility of ensuring the secrecy of your GuideR Adventure Account password and login information. All actions, including Reservations associated with your GuideR Adventure Account, fall under your responsibility. In case of any unauthorized access to your GuideR Adventure Account, you commit to notifying us promptly.

  1. Quotation Basis

Each Product’s price is usually quoted on a per-person basis unless otherwise mentioned.

  1. Exchange Rate Influence

Prices derive from the local tariff at the time of quoting and are converted using the prevailing foreign-exchange rate as determined by GuideR Adventure. For more details on currency conversions, refer to the section on Currency Conversion.

  1. Price Changes

Prices can change without prior notice until a Booking is finalized.

  1. Exclusions

Unless otherwise stated by the Supplier, prices typically exclude local taxes, use-fees, departure fees, security charges, port fees, park fees, customs, immigration, agricultural fees, passenger-facility charges, or international transport tax.

  1. What’s Not Covered

Inclusions are based on Supplier’s terms. Prices generally exclude tips, passport and visa fees, personal insurance, personal items, taxes, duties, beverages, and food unless specifically mentioned by the Supplier.

  1. Currency Conversion

If GuideR Adventure offers a currency converter, its rates are derived from various public sources and should be seen as general guidelines. These rates aren’t verified daily, and actual rates might differ. GuideR Adventure doesn’t guarantee absolute accuracy and isn’t responsible for price changes due to currency fluctuations.

  1. Booking Payments

When you make a Booking, GuideR Adventure handles your payment details and processes it as described later. In this scenario, GuideR Adventure acts as a limited payment collection agent for the Supplier, collecting payments for relevant Products. Payments are generally required in full via credit or debit card during Booking unless specified differently. The statement will list the payee as GuideR Adventure.

  1. Additional Charges

The total value of your Booking might be subject to additional charges like taxes, duties, foreign transactions, currency exchange, or other fees. Your bank or card company might convert payments into local currency and charge extra fees, leading to discrepancies between the displayed amount and the final charged amount. For any queries regarding conversions or fees, we recommend contacting your bank or card company.

  1. Responsibility for Unauthorized Bookings

As a user of our Services, you acknowledge and agree that: (1) Neither GuideR Adventure nor its partners shall be held liable to you or any third party for unauthorized Reservations made using your GuideR Adventure Account and/or GuideR Adventure Account Credentials; and (2) Unauthorized access or use of your GuideR Adventure Account and/or GuideR Adventure Account Credentials might lead to potential liabilities towards both GuideR Adventure and other users.

  1. Proprietary Nature of Content

The content and materials on the Website (including, but not limited to, messages, data, text, music, sound, photos, graphics, videos, software, and other materials collectively termed as “Website Materials”), as well as the infrastructure utilized to present such Website Materials, are proprietary to GuideR Adventure. You commit not to modify, reproduce, distribute, showcase, transmit, publish, license, or create derivative works from any Website Materials or procure any services or products through the Website without our prior written consent. Any other utilization of the Website Materials demands prior written approval from GuideR Adventure.

  1. GuideR Adventure Tickets

When you book a product, you’ll receive a GuideR Adventure-branded ticket or, in some cases, a voucher from the Supplier. This ticket, issued on behalf of the relevant Supplier, serves as proof of your booking. To access and print your ticket, you’ll be directed to a secure webpage hosted by GuideR Adventure, which provides a link to your ticket. Some bookings might also offer an electronic ticket in addition to or as an alternative to a paper ticket.

To redeem your product, it’s essential to provide the original, authentic ticket to the appropriate Supplier. Without a valid ticket, your booking cannot be honored or redeemed. It’s crucial to familiarize yourself with the terms and conditions related to your booking to ensure you know what the Supplier requires in terms of ticket presentation.

For added security, when redeeming your ticket, you’ll need to present a valid photo ID and sign the ticket. In certain instances, the Supplier might also require you to showcase the payment card you used to make the purchase, especially for attractions and show tickets. You’ll be informed during checkout if this is necessary. If you have any queries regarding these requirements, please reach out to the GuideR Adventure Customer Care team.

  1. Prohibited Activities

You also concur that you will neither undertake nor aid others in:

a. Using the Website or Website Materials for unlawful or commercial objectives.

b. Using automated means, including but not limited to robots, spiders, or scrapers, to access or monitor any Website Materials without our express written consent.

c. Circumventing any measures we employ to prevent or restrict access to the Website.

d. Imposing an unreasonable load on our infrastructure or making excessive traffic demands on the Website.

e. Deep-linking to any part of the Website without our express written permission.

f. Integrating any section of the Website into another website without our prior written consent.

g. Trying to modify, reverse engineer, or tamper with any software used on the Website.

h. Using the Website to harass, defraud, stalk, or threaten another person.

i. Transmitting spam, chain letters, junk emails, or any unwanted mass messaging through the Website.

j. Engaging in actions that may create conflicts of interest, such as trading reviews or soliciting them.

k. Promoting discrimination or bigotry against any group through the Website.

l. Infringing third-party rights, including intellectual property rights, while using the Website.

m. Transmitting or submitting any illegal or pornographic content through the Website.

n. Soliciting personal details from minors or threatening any person, including minors.

o. Attempting unauthorized access to the Website or any related networks or systems.

p. Transmitting any harmful entities like viruses or worms through the Website.

q. Interfering with the proper functionality of the Website.

r. Breaching the security protocols of any network while using the Website.

s. Causing harm or disruptions to the Website.

  1. Outfitter Partnerships

Note that we help customers research and book guided adventure travel experiences; however, we are not a travel or tour agency, and we do not provide such experiences ourselves. When you are booking, you will be purchasing a guided trip and/or service directly from the outfitter and/or guide via our platform.

Our Service connects you with independent guides and outfitting services (“Outfitter Partners”). We partner with local outfitters and guides to offer outdoor adventures accessible to everyone, such as fly fishing, mountain biking, rock climbing, and more. While we strive to offer accurate information and ensure the quality of Outfitter Partners, we do not control and are not responsible for their services. Any issues or disputes related to services provided by Outfitter Partners should be resolved directly with them..

  1. Safety and Assumption of Risk

Participation in adventure travel activities involves inherent risks and dangers, which could result in serious personal injury, death, or property damage. By booking an adventure travel activity through our Website, you understand and agree that you are assuming these risks. You acknowledge that GuideR Adventure is not responsible for the acts or omissions of the Outfitter Partners or any other third parties. You agree to take all necessary precautions and follow all safety instructions provided by the Outfitter Partners.

  1. Pricing and Fees

The prices for adventure travel activities listed on our Website are set by our Outfitter Partners and may be subject to change. Prices do not include any additional fees that may be incurred during the activity, such as equipment rental fees, park entrance fees, or transportation fees. Any such additional fees will be clearly stated in the activity description or will be communicated to you by the Outfitter Partner. All prices are payable in the currency specified on the Website at the time of booking.

  1. User Conduct

As a user of our Website and participant in the adventure travel activities, you agree to conduct yourself in a respectful and responsible manner. You agree to respect local cultures, protect the environment, and adhere to all safety instructions provided by the Outfitter Partners. Any behavior that is deemed harmful or disrespectful may result in the termination of your account and your access to our Services.

  1. Health and Fitness Levels

Certain adventure travel activities may require a certain level of health or fitness. It is your responsibility to ensure that you are physically capable of participating in the activity. If you have any medical conditions or other health concerns that may affect your ability to safely participate in an activity, you should consult with a healthcare professional before making a booking. You understand and agree that you participate in the activities at your own risk and that GuideR Adventure is not responsible for any health issues that may arise as a result of your participation.

  1. Cancellation Policy

Our cancellation policy varies depending on the specific terms set by our Outfitter Partners. Please review the cancellation policy carefully before making a booking. If you wish to cancel a booking, you must do so in accordance with the applicable cancellation policy.

  1. Refund Policy

If you are eligible for a refund according to the applicable cancellation policy, refunds will be processed within 24 hours to the original payment method. Please note that the processing time for the refund to appear in your account may vary depending on your bank or credit card issuer. Please refer to the refund policy for more information on this section.

  1. Permitted use 

You agree to use the Site and the Services only for purposes that are permitted by these Terms and in compliance with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions. You may only use the Site and Services for your non-commercial, non-exclusive, non-assignable, non-transferable, and limited personal use, and no other purposes.

You will not (and will not attempt to):

  1. Access any of the Services by any means other than through the interface that is provided by GuideR Adventure;
  2. Gain unauthorized access to GuideR Adventure’s computer system or engage in any activity that interferes with the performance of, or impairs the functionality or security of the Site, the Services, GuideR Adventure’s networks, and computer systems;
  3. Access any of the Site or the Services through any automated means or with any automated features or devices (including use of scripts or web crawlers);
  4. Access or collect any personally identifiable information, including any names, email addresses or other such information for any purpose, including, without limitation, commercial purposes;
  5. Reproduce, duplicate, copy, sell, trade, or resell any aspect of the Site or the Services for any purpose; and
  6. Reproduce, duplicate, copy, sell, trade or resell any products or services bearing any trademark, service mark, trade name, logo or service mark owned by GuideR Adventure in a way that is likely or intended to confuse the owner or authorized user of such marks, names or logos.
  1. User Contributions on the Website

Users of the Website, including you, may contribute in various ways such as submitting emails, writing reviews, making posts, uploading photos or videos, commenting, suggesting, sharing ideas, rating contributions by others, and other similar activities (“User Contributions”). GuideR Adventure may use these contributions for multiple purposes, including displaying them on the Website, reformatting, translating, editing for clarity, creating derivative works, promoting, distributing, and allowing other platforms to do the same.

  1. Rights Granted by User

By offering User Contributions, you grant GuideR Adventure and its partners a global, non-exclusive, royalty-free, perpetual, transferable, and fully sublicensable right to use, reproduce, modify, adapt, distribute, publish, display, and create derivative works from such User Contributions. You permit GuideR Adventure to use any name associated with your User Contributions. You acknowledge that while GuideR Adventure may attribute your contributions, it’s at our discretion. Any violation of these terms regarding your User Contributions may result in legal action. User Contributions are deemed non-confidential and non-proprietary.

  1. Advertisements

Advertisements or other information might appear alongside your User Contributions on the Website. You are not entitled to compensation for these ads, and the nature of such advertising may change without prior notice.

  1. Interactive Sections

The Website may feature discussion boards, review sections, and other interactive spaces (“Interactive Sections”). You are responsible for your interactions within these sections. By participating, you agree not to post any User Contributions that:

a. Are unlawful, defamatory, obscene, or otherwise objectionable.

b. Promote criminal activities or violate any regulations, including those of financial institutions.

c. Infringe on any intellectual property rights.

d. Falsely represent your identity or affiliation.

e. Promote advertisements, contests, or solicitations.

f. Disclose private third-party information.

You are solely responsible for your User Contributions. Any reliance on its content is at the risk of the user. You must have the rights to use and authorize the use of your User Contributions as described.

GuideR Adventure is not responsible for any User Contributions or any damages arising from them. This includes inaccuracies, defamation, slander, libel, falsehoods, obscenity, or profanity.

  1. Monitoring User Contributions

Though GuideR Adventure is not obligated to monitor User Contributions, we reserve the right to review, modify, or remove any content without notice. It’s your responsibility to back up your User Contributions.

  1. Violation of Terms

Any misuse of the Interactive Sections or the Website that goes against these terms may lead to suspension or termination of your access rights.

  1. Limited License and Site Access; Acceptable Use

You may not: (a) resell or make any commercial use of this Site or any of the contents of this Site; (b) modify, adapt, translate, reverse engineer, decompile, disassemble or convert any of the contents of this Site not intended to be so read; (c) copy, imitate, mirror, reproduce, distribute, publish, download, display, perform, post or transmit any of the contents of this Site in any form or by any means; or (d) use any data mining, bots, spiders, automated tools or similar data gathering and extraction methods on the contents of the Site or to collect any information from the Site or any other user of the Site.

You use this Site at your own risk. You agree that you will be personally responsible for your use of this Site and all of your communication and activity on this Site. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms and Conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

  1. Accounts, Registrations, and Passwords

If you use this Site and such use requires setting up an account and/or password(s), you are solely responsible for maintaining the confidentiality of your account and password(s) and for restricting access to your computer.  If you open an account, register, or otherwise provide us with any information, you agree to provide us with current, complete, and accurate information as requested by any forms. GuideR Adventure is not responsible for any errors or delays in responding to any inquiry or request caused by any outdated or incorrect information provided by you or any technical problems beyond the control of GuideR Adventure. You acknowledge and agree that any login, identifier, or password issued in connection with this Site (each a “Password”) is confidential information and must be kept secure. You may not disclose such a Password to another person or entity or permit another entity to access the Site using such a Password. You must notify GuideR Adventure immediately of any breach of security or unauthorized use of your account. GuideR Adventure cannot be responsible and disclaims all liability in connection with, the use of any information that you post or display on this Site.

  1. Intellectual Property Rights

Your use of the Site and its contents grants no rights to you concerning any copyright, designs, and trademarks and all other intellectual property and material rights mentioned, displayed, or relating to the Content (defined below) on the Site.  All Content, including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site, are protected by national intellectual property and other laws. Any unauthorized reproduction, redistribution or other use of the Content is prohibited and may result in civil and criminal penalties. In addition to the intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio, or text on the Site.

Please note the phrase “GuideR Adventure Accessible Adventure Awaits” is a pending trademark of GuideR Adventure LLC. Unauthorized use or duplication of this trademark without express and written permission from GuideR Adventure LLC is strictly prohibited.

  1. Monitoring Activity

GuideR Adventure has no obligation to monitor this Site or any portion thereof. However, we reserve the right to review any posted content and remove, delete, redact or otherwise modify such content, in our sole discretion, at any time and from time to time, without notice or further obligation to you. GuideR Adventure has no obligation to display or post any content. GuideR Adventure, subject to the Privacy Policy reserves the right to disclose, at any time and from time to time, any information or posted the content that it deems necessary or appropriate, including without limitation to satisfy any applicable, law, regulation, contractual obligation, legal, dispute process, or governmental request.

GuideR Adventure expects all users to respect the intellectual property rights of others. GuideR Adventure may remove material that appears in its sole discretion to infringe upon the intellectual property rights of others and we will terminate the access rights of any repeat infringer. If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may notify us at support@guideradventure.com. The notification must include the following information: physical or electronic signature of the owner or authorized agent of the owner of the allegedly infringed work; identification of the allegedly infringed work; identification of the material that is claimed to be infringing and reasonably sufficient information for GuideR Adventure to locate the material; contact information of the notifying party, such as an address, telephone number, and email; a statement that the notifying party has a good faith belief that the use of the material in the manner complained of is not authorized by the owner of the allegedly infringed work, its agent or the law; and a statement, under penalty of perjury that the information in the notification is accurate and the notifying party is the owner or authorized agent of the allegedly infringed work.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, GUIDER ADVENTURE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY (A) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE AS TO THE SITE AND ITS CONTENT, INCLUDING THE INFORMATION, DATA, SOFTWARE, OR PRODUCTS CONTAINED THEREIN, OR THE RESULTS OBTAINED BY THEIR USE OR AS TO THE PERFORMANCE THEREOF, (B) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING, AND (C) WARRANTIES OR CONDITIONS OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE. This limitation on liability includes, but is not limited to, any (i) errors, mistakes, or inaccuracies in any Content or for any loss or damage of any kind incurred by you as a result of your use of or reliance on the Content; (ii) the transmission of any bugs, viruses, Trojan horses or the like which may infect your equipment, failure of mechanical or electronic equipment; (iii) unauthorized access to or use of the Site or GuideR Adventure’ secure servers and/or any personal information and/or financial information stored therein; or (iv) theft, operator errors, strikes or other labor problems or any force majeure.

You agree to indemnify and hold GuideR Adventure and its subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any suit, action, claim, demand, penalty or loss, including reasonable attorneys’ fees, made by or resulting from any third party due to or arising out of your use of the Site, breach of the Terms and Conditions or the materials it incorporates by reference, or your violation of any law, regulation, order or other legal mandates, or the rights of a third party.

  1. Dispute Resolution & Governing Laws

In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

These Terms and any dispute or claim arising out of or related to these Terms, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of North Carolina. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communication is in writing.

If any of these Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, that term shall be deemed severable and shall not affect the validity and enforceability of any remaining terms or conditions.

  1. Assignment

We shall be permitted to assign, transfer, or subcontract our rights and obligations under these terms without your consent or any notice to you. You shall not be permitted to assign, transfer, or subcontract any of your rights and obligations under this agreement.

  1. Force Majeure

GuideR Adventure is not liable for any delays caused by circumstances beyond GuideR Adventure’s control, e.g. general labor dispute, extreme weather, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above.

  1. Entire Agreement

These Terms and Conditions set forth the entire understanding and agreement between you and GuideR Adventure concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written concerning the Site. Customers Registering a Profile and Creating a Seller Profile

Customer Profile Registration: Users are welcome to register for a profile on our Site. This allows for a more tailored experience, enabling features such as saving favorite adventures, tracking bookings, and receiving special offers. When registering, users may be asked for personal details like name, email address, and other pertinent information to enhance the user experience.

Seller Profile Creation: For those interested in listing adventure experiences on our Site, a seller profile is required. This involves providing details about the adventure, along with personal or business-related information for verification purposes. This ensures that customers receive genuine and safe experiences.

  4. Processing Time: We will acknowledge your request within seven (7) business days and process your data deletion request within fourteen (14) days. You will receive a confirmation once the deletion is complete.

SMS Communication: By opting into SMS communications, you consent to receive test messages from us regarding your inquiries, bookings, and promotional offers. We comply with the Telephone Consumer Protection Act (TCPA) and all applicable U.S. laws to protect your privacy and ensure responsible messaging practices. 

Direct Marketing.  We may use your personal information to send you GuideR Adventure-related marketing communications as permitted by law.  You will have the ability to opt-out of our marketing and promotional communications.

  • Request a list of third party marketers. California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any).  You can submit such a request by sending an email to ___@localhost with “Shine the Light” in the subject line.  The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident.
